Sales taxes on natural gas or electricity used during a monthly billing period is either totally exempt or taxable, and it is completely based upon the predominant use of the natural gas or electricity measured by that meter. A predominant usage study, or a Utility Study, is performed to establish what percentage is being used for exempt purposes as defined by the Texas Comptroller.
Furthermore, Texas law allows industries eligible for this exemption, including manufacturers, fabrication, and processors, to apply for a refund of all sales tax paid over the preceding 48 months or since the meter was connected, whichever is less. The study must be completed and on file at the location of the entity claiming the exemption at the time an exemption certificate is submitted to the utility company.

We complete and submit all necessary documentation to support our studies and, as needed, defend them against the Texas Comptroller’s office. WHAT INDUSTRIES QUALIFY FOR EXEMPTION?
What is a Utility Study?
A Predominant Use Study is based on the Texas State Comptroller’s Office tax codes (TAC Title 34, Part 1, Chapter 3, Subchapter O, Rule 3.295). The law requires a Predominant Usage Study be filed to qualify a facility for state and local sales tax exemption on electricity and natural gas consumption.
